All participants are required to review this Liability Waiver prior to their trip. You will be asked to acknowledge that you have reviewed this waiver at the time of booking.
In consideration of being permitted to participate in a Private Guided Fishing Experience (the “Activity”), the Participant, on behalf of themselves and their guests, agrees to release, waive, and discharge Salmon Limited Sportfishing Niagara, Chase the Bite Sportfishing, and John Mastrandrea (collectively referred to as the “Activity Provider”), including their spouses, heirs, executors, administrators, legal representatives, and assigns, from any and all claims, demands, actions, or causes of action for personal injury, property damage, or death arising out of or related to participation in the Activity, including those arising in whole or in part from the negligence of the Activity Provider.
The Participant acknowledges and agrees that:
Participation in fishing and boating activities involves inherent risks, including but not limited to water-related hazards, changing weather conditions, the use of fishing equipment, slips and falls, and other unforeseen risks.
The Participant confirms that they and their guests are physically able to safely participate and have no medical conditions, physical limitations, or disabilities that would interfere with safe participation. Medical clearance will be obtained if necessary.
The Participant understands that participation would not be permitted without signing this waiver.
This waiver legally prevents the Participant and their guests from pursuing legal action against the Activity Provider for injuries, death, or property damage arising from participation in the Activity.
The Participant acknowledges that they have had the opportunity to seek independent legal advice prior to signing this waiver.
This waiver is binding upon the Participant, their guests, spouse, heirs, executors, administrators, legal representatives, and assigns.
This waiver constitutes the entire agreement between the Participant and the Activity Provider and shall be governed by and construed in accordance with the laws of the Province of Ontario.
By acknowledging this waiver through the online booking process prior to departure, the Participant confirms that they have read, understood, and voluntarily agreed to all of the terms and conditions stated above on behalf of themselves and all guests in their party.
